Website Terms & Conditions
These Terms govern use of the Digihuis website, website forms, and general informational or diagnostic outputs made available through or from the website.
They do not replace a separate proposal, quotation, statement of work, service agreement, order form, or other accepted commercial document for paid Digihuis work.
- Using the website or sending an enquiry does not automatically create a paid services contract.
- The Operational Intelligence Review is scoped and agreed separately if Digihuis accepts an engagement.
- Privacy, cookies, analytics, and personal-information handling are described in the Privacy Policy.
- Any Snapshot or similar diagnostic output is informational, input-dependent, and not a guarantee of business outcomes.
1. Introduction
These Website Terms & Conditions apply to your access to and use of the Digihuis website at https://digihuis.com/, including its pages, content, forms, and any general informational or diagnostic functionality Digihuis makes available through or from the website.
By using the website, you agree to these Terms. If you do not agree, do not use the website.
2. About Digihuis
For these Terms, “Digihuis”, “we”, “our”, and “us” mean Digihuis (Pty) Ltd.
- Legal entity: Digihuis (Pty) Ltd
- Registration number: 2015/272575/07
- Trading name: Digihuis
- Website: https://digihuis.com/
- General and support contact: support@digihuis.com
- Information Officer and privacy contact: info@digihuis.com
3. Acceptance and scope
These Terms govern website use. They cover browsing the site, using contact or enquiry forms, requesting an Operational Intelligence Review, and using or relying on website content and general website outputs.
These Terms do not, by themselves, create a client-services retainer, subscription, or paid consulting agreement.
4. Eligibility and authority
You may use the website only if you have the legal capacity to do so.
If you use the website or submit information on behalf of a company or another organisation, you confirm that you are authorised to do so and to provide the information you submit.
5. Website use
You may use the website only for lawful purposes connected to understanding Digihuis, assessing potential fit, or contacting Digihuis.
You must not:
- use the website in a way that is unlawful, fraudulent, abusive, defamatory, or misleading
- upload, send, or introduce malware, harmful code, or any material designed to disrupt the website or related systems
- attempt to gain unauthorised access to the website, servers, accounts, or connected systems
- scrape, copy, republish, or commercially exploit website content beyond what applicable law or Digihuis expressly allows
- submit information that infringes another person’s rights or that you are not authorised to provide
6. Services, enquiries, and paid engagements
The website describes Digihuis’s Operational Intelligence services and related capabilities for general information. Website descriptions are not a binding offer capable of automatic acceptance.
Submitting a contact form, enquiry, or Review request does not require Digihuis to accept an engagement. It also does not require you to buy anything.
A paid engagement is formed only when the parties agree the relevant commercial and scope terms through a proposal, quotation, statement of work, service agreement, order form, written scope, or another clearly accepted arrangement.
If a separate accepted agreement applies to paid work, that separate agreement governs that engagement to the extent of any conflict with these Terms.
The current website does not provide a public online checkout, recurring subscription sign-up, or card-payment flow for Digihuis consulting services.
7. AI Growth Snapshot and diagnostic tools
Digihuis may from time to time make available, promote, or link to free diagnostic tools or informational outputs, including the AI Growth Snapshot, whether within the website or through a separate Digihuis-linked runtime.
Unless Digihuis expressly states otherwise for a specific tool:
- those outputs are informational and diagnostic in nature
- they depend on the quality, completeness, and accuracy of the information provided and any public or technical signals available at the time
- they may be generated automatically, with or without later human follow-up
- they are not guaranteed to identify every issue, risk, bottleneck, or opportunity
- they do not guarantee revenue, operational, commercial, or financial outcomes
Any Snapshot or similar output is intended to support decision-making, not replace human judgement or a paid, scoped advisory engagement.
8. Submitted information
If you submit information through the website, you remain responsible for that information and confirm that, to the best of your knowledge, it is accurate, lawful, and provided with the necessary authority.
You must not intentionally submit unlawful, infringing, malicious, or unnecessary sensitive material through a general website form.
You keep ownership of your information and materials. You give Digihuis a limited right to receive, store, review, process, and analyse what you submit as reasonably necessary to:
- respond to your enquiry
- assess fit and scope for a requested interaction or engagement
- generate or support any requested website output or diagnostic interaction
- manage related communications and records
Personal-information handling remains subject to the Privacy Policy.
9. Intellectual property
Unless stated otherwise, the website and its content are owned by or licensed to Digihuis. This includes website copy, branding, graphics, layouts, reports, frameworks, templates, software, code, documentation, and original materials made available through the site.
Digihuis also claims rights in its proprietary methods and materials, including the Operational Intelligence Method™, Connect, Detect, Brief, leadership briefing formats, diagnostic structures, Snapshot architecture and content, and related original know-how and materials.
These Terms do not transfer any Digihuis intellectual-property rights to you. You may view the website and use its content for your own internal evaluation of Digihuis, but you may not copy, adapt, distribute, publish, reverse engineer, or commercially use protected materials without Digihuis’s prior written permission, except where applicable law allows it.
10. Your materials and confidentiality
Digihuis does not claim ownership of your pre-existing trademarks, systems, data, documents, or other materials.
General website forms are not a full mutual non-disclosure agreement. Digihuis will handle submitted information in line with the Privacy Policy, these Terms, and any later agreement that applies.
Please do not submit highly sensitive or confidential information through a general-purpose website form unless it is reasonably necessary and appropriate for that interaction, or Digihuis has specifically asked for it through a suitable channel.
If stronger confidentiality obligations are needed, those should be agreed separately, for example in an NDA or a client-services agreement.
11. Third-party services and links
The website may rely on or link to third-party services, platforms, or websites. Those third parties operate under their own terms, privacy practices, and technical conditions.
Digihuis is not responsible for third-party content, products, services, availability, or how external websites handle your information once you leave the Digihuis website.
13. Availability, security, and changes
Digihuis aims to keep the website available, accurate, and reasonably secure, but does not promise that the website will always be uninterrupted, error-free, current, or free from vulnerabilities.
Digihuis may update, suspend, withdraw, or change website content, pages, tools, or features at any time.
You must not attempt to bypass security, test the website by intrusive means without permission, or interfere with the normal operation of the site.
14. Disclaimers and no guaranteed outcomes
The website and its content are provided for general information about Digihuis and its methods, services, and tools.
To the fullest extent permitted by applicable law:
- website content may change and may not always reflect the latest commercial scope or technical position
- service descriptions, examples, and outputs are not guarantees of fit, acceptance, or results
- diagnostic or AI-supported outputs depend on available signals and submitted inputs
- business decisions made using website content or outputs remain your responsibility
Nothing on the website is legal, tax, accounting, investment, or regulated professional advice.
15. Liability, indemnity, and statutory rights
To the fullest extent permitted by applicable law, Digihuis will not be liable for indirect, incidental, consequential, special, punitive, or loss-of-profit damages arising from your use of, inability to use, or reliance on the website, its content, or linked third-party services.
Subject to applicable law, Digihuis’s liability for direct loss arising from website use is limited to loss that is reasonably foreseeable and directly caused by Digihuis’s breach of these Terms.
Nothing in these Terms excludes or limits liability where that would be unlawful, including liability that cannot lawfully be excluded under applicable consumer-protection law, or liability for fraud, wilful misconduct, or gross negligence.
You agree, to the extent permitted by law, to indemnify Digihuis against third-party claims, losses, or costs arising from your unlawful use of the website, your breach of these Terms, or material you submit without the necessary rights or authority.
16. General legal terms
Suspension or restriction
Digihuis may suspend or restrict access to all or part of the website where reasonably necessary for maintenance, security, legal compliance, or misuse prevention.
Changes to these Terms
Digihuis may update these Terms from time to time. The updated version becomes effective when posted on the website, subject to any additional notice required by law.
Governing law and disputes
These Terms are governed by the laws of the Republic of South Africa.
Any dispute relating to these Terms or website use will be subject to the jurisdiction of the competent courts of South Africa, subject to any mandatory rights or remedies you may have under applicable consumer law.
Severability and no waiver
If any part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply to the fullest extent permitted by law. A failure by Digihuis to enforce a right under these Terms is not a waiver of that right.
Entire website-use agreement
These Terms, together with the Privacy Policy, form the website-use agreement between you and Digihuis for the current website.
